Non-Resident Investment in Irish Property

In recent months, there has been an increase in the number of non-resident individuals seeking to acquire Irish property through an Irish company. In many cases, these individuals are Irish expats looking to return to Ireland or others simply seeking to invest in Irish property as part of their investment portfolio.

 It can be difficult for non-resident individuals to obtain funding in Ireland personally for such an investment due to restrictions in place with Irish financial institutions providing funds to non-residents. However, these funding restrictions can often be overcome where a non-resident person establishes an Irish Special Purpose Vehicle company (“SPV”). There are specific tax rules that apply to these SPVs that can allow the property acquisition to be managed in an efficient way that also satisfies the strict lending criteria of certain financial institutions.

We have assisted several clients in establishing Irish SPVs for this purpose and have developed contacts with Mortgage Brokers and Solicitors who are familiar with the process and that can facilitate the implementation of this structure.

Covid 19 related concessions re benefit in kind and personal tax residency

In late December, Irish Revenue issued an e-brief updating their guidance regarding various Covid-19 related concessions which issued last March in relation to benefit in kind (BIK) and cross border employment matters.
